Dis-Chem Gold Anti-Cellulite Detox – ASA ruling

A consumer lodged a complaint against packaging for Dis-Chem’s anti cellulite detox product: “Dis-Chem GOLD ANTI-CELLULITE DETOX”. In essence, the complainant submitted that the name of the product is misleading as it suggests that the product is able to combat or prevent cellulite and/or detoxify the body. This is not true and cannot be substantiated.

Dis-chem submitted that the product has been discontinued and should have been removed from all shelves at all Dis-Chem stores.

The question should be asked, why is Dis-Chem selling this scam product in the first place!?

Doctor Steinman lodged a consumer complaint against packaging for Dis-Chem’s anti cellulite detox product.

The packaging states, inter alia, “Dis-Chem GOLD ANTI-CELLULITE DETOX”.

COMPLAINT
In essence, the complainant submitted that the name of the product is misleading as it suggests that the product is able to combat or prevent cellulite and/or detoxify the body. This is not true and cannot be substantiated.

RELEVANT CLAUSE OF THE CODE OF ADVERTISING PRACTICE
In light of the complaint Clause 4.1 of Section II (Substantiation) of the Code was taken into account.

RESPONSE
The respondent submitted that the product has been discontinued and should have been removed from all shelves at all Dis-Chem stores. The respondent enquired from the complainant as to where he had seen the product being displayed, in order to arrange for its removal. It is also noted that the complainant has since supplied the requested information.

ASA DIRECTORATE RULING
The ASA Directorate considered all the relevant documentation submitted by the respective parties.

The ASA has a long standing principle which holds that where an advertiser provides an unequivocal undertaking to withdraw or amend its advertising in a manner that addresses the concerns raised, the undertaking is accepted without considering the merits of the matter.

As the respondent’s undertaking to discontinue the product addresses the complainant’s concerns, there is no need for the Directorate to consider the merits of the matter.

The undertaking is therefore accepted on condition that the advertising is withdrawn in its current format within the deadlines stipulated in Clause 15.3 of the Procedural Guide, and is not used again in future.

The respondent is cautioned, to ensure that any stock of the product is removed from all stores with immediate effect.

    I used this product from March 2012 until I could no longer find it. For me it most certainly worked, and since not using it have seen an increase in my cellulite of 2cm. This is by continuing the same exercise and diet program. The only difference is I’ve stopped using these tablets! I have used NO other weight loss products etc. It’s sad that one complaint prevents many others from the choice of using a specific product!

    The product was worked. It was well priced and it’s hard to find those quality ingredients again.
