Green coffee bean weight-loss scam

A number of companies in South Africa are marketing Green Coffee Beans as a great product for weight-loss. Well, there is no evidence that this is true. Big scam. Now the USA Federal Trade Commission has acted against companies in the USA making weight-loss claims for green coffee beans. If only the same would happen here!

Cupping therapy – ASA ruling

Dr Maroula Lambis t/a Holistic Healthcare, made claims that “cupping therapy” can “improve[es] circulation by removing toxins, congestion and inflammation … brings nutrient rich blood to the affected area, facilitating the body’s healing process”, for which a consumer laid a complaint with the ASA arguing that there is no evidence that these claims are true. As Dr Lambis could not supply proof that the claims could be proven, the ASA ruled against the claims. Now a consumer complained that the claims continue to be made, this being a breach of the previous ASA ruling. The ASA agreed.

Reduline 36 – ASA breach complaint

Arcadia Home Shopping continued to make unsubstantiated claims for its product, Reduline 36. A consumer reported to the ASA that these unsupported claims were still being made, and the ASA agreed that this was contrary to the ASA code, and upheld the breach complaint.

Snail gel gets squashed

This article published in The Times, is old, but has only come to our attention now. It is still relevant for Glomail continues to market Celltone but without the claims previously made and ruled against by the ASA, when in fact their own research shows that the product does not work.

Scary stuff! What does this tell you about the ethics and morals of the owners of the company?

Vita Aid Ph Balance – still making false claims

Can one trust anything that  Arcadia Home Shopping claims in adverts? There have been numerous rulings against products from this company. A previous ASA ruling against Vita Aid Ph Balance required Arcadia to stop making those claims. They did not and a consumer noticed, laying a breach complaint with the ASA. The ASA ruled in the complainants favour.

USN 19 TESTO MASS – ASA ruling

USN claimed that this product is an “Ergogenic aid” and “Testo Booster”. A complaint was laid claiming that these claims are not justified and cannot be proved to be true.

USN responded by saying that the claims would be removed from the website and the product.

JOY! Magazine, Caxton publishers and Slimbetti adverts

What is the responsibility of editors, production managers and owners of magazines with regard to accepting advertising for unsubstantiated or scam products? The majority of magazines are members of representative groups that are co-signatories to the Advertising Standards Authority (ASA) code and are expected to comply with the ASA code.

Slimbetti has managed to re-advertise in Caxton magazines after asserting that the ASA had accepted their claims (a blatant lie) after Caxton had initially refused further advertising following an earlier ASA ruling. Caxton publishers include magazines such as People, Vrouekeur, Rooi Rose, Essentials, Your family, etc. A letter (similar to the one at the end of this post) had them accept that they had erred and would discontinue further advertisements (except for those too late to stop).

ImuPro – unconscionable

ImuPro, a blood test offered by  WellPro, a division of Molecular Diagnostic Services (Pty) Ltd, is bringing Dr Camille Lieners to South Africa in order to promote this blood test for assessing “hypersensitiivies”. It should be noted that Dr Lieners is neither a medical doctor nor a dietitian. She has a PhD from Luxembourg. She is, in other words, not a clinician, and does not directly care for healthy people or patients. But she is dispensing clinical ‘advice’. It is unclear what her ‘PhD’ was about, and it is unclear why she should be regarded as an expert in the clinical setting.

The owner of  Molecular Diagnostic Services, Dr Dennis York, continues to promote this product for assessing “hypersensitivies” in spite of ASA rulings against the claims, and in spite of international consensus and position statements from allergy societies and representative organisations throughout the world including … Read the rest

ImuPro – ASA Ruling

A consumer complaint was laid with the ASA against the advertising claims for ImuPro: ” In essence the complainant submitted that the study relied on in support of this claim is inadequate. Recent publications and position statements by, inter alia, the American Academy of Allergy, Asthma and Clinical Immunology and the European Academy of Allergy, Asthma and Immunology have effectively found that the IgG method is unreliable and cannot be recommended. Given this, consumers are misled into believing that the Atkinson study amounts to conclusive proof of efficacy for the respondent’s test, which is not the case.”

The ASA felt that they were “not in a position to determine whether the respondent’s interpretation of the Atkinson study is valid or not.”
